Terms and Conditions for Personal Training and Classes

 

Introduction

Your instructions to commence personal training will constitute acceptance of these Terms and Conditions when you will become a client (a “Client” or “you”). You are asked to pay special attention to the provisions related to cancellations. This does not affect your statutory rights.

 

Personal Agreement
I agree that 50 Plus Fitness will not be held responsible for any lost or stolen personal belongings. I understand classes may be physically strenuous and that full care must be taken when receiving instructions and performing exercises. I accept that there is potential risk of personal injury, property loss or death, and I agree that neither I, my heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against 50 Plus Fitness or its members for any personal injury, property damage/loss, or wrongful death, whether caused my negligence or otherwise.

 

Trainer’s Obligation

The Trainer will use his/her skills and knowledge to design a safe programme of exercise that will take into account your lifestyle, personal goals, fitness levels and medical history.

The Trainer will provide the coaching, supervision, advice and support that you will need to achieve your goals. Apart from the initial consultation (and the first personal training session if taken immediately afterwards) each personal training session will last approximately 30 minutes unless otherwise agreed (a “Session”).

The Trainer will provide instruction, advice, supervision and support needed within a group setting (“Class”). Each class will last around 60 minutes, unless otherwise stated.

You understand that the results of any fitness programme cannot be guaranteed. Your progress depends on your effort and co-operation in and outside of the Sessions/Classes. You acknowledge that individual results may vary and that no particular result is guaranteed by your Trainer.
All Client information will be kept strictly private and confidential.

 

Your Obligations

It is understood between you and your Trainer that both must commit to your training programme 100% in order for you to achieve results.

You are required to arrive on time for each Session/Class so that the Trainer’s full training plan is achieved on each visit.

You are required to wear appropriate clothing and footwear.

You are required to complete a Client History form before undertaking your first personal training session.

Your Trainer may require a letter of ‘medical clearance’ from your GP. Please be aware that your GP may charge for providing this letter.
You understand and agree that it is your responsibility to inform the Trainer of any conditions or changes to your health, now and ongoing, which might affect your ability to exercise safely and with minimal risk of injury.

If your Trainer requires further medical information from a practitioner, you must provide such details.

 

You understand that there are inherent risks in participating in a programme of strenuous exercise. If you sustain or claim to sustain any injury while participating in training, you acknowledge that the Trainer is not responsible, except where the injury was caused by his/her gross negligence or intentional act.

 

Your Trainer cannot be held liable in any way for undeclared or unknown medical conditions.

 

If you bring children or minors to the Session/Class they remain your responsibility throughout and the Trainer cannot be held liable.

 

Cancellation and Refunds

1.      At least 24 hours’ notice of cancellation for a pre-booked Casual class is required.

2.      Notice of less than 24 hours (cancellations at ANY time the day before a booked class) and un-attended classes without notice of cancellation will require full payment of the class fee.

3.      Unforeseen events will be taken into consideration on the day.

4.      Once purchased, your Sessions are non-refundable.

Providing some information is optional. If you choose not to enter email address, we'll be unable to provide certain services.

Our website is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to provide information and services to you. Your data may be stored through Wix.com's data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall. We receive, collect and store any information you provide us. We may use software tools to measure and collect information about use of the website and interactions with us.
